NEXÉ Smart Home Terms and Conditions

Effective Date: June 12, 2026

Please read these Terms and Conditions carefully before using the NEXÉ mobile application. The App is developed and operated by Confio Technologies Private Limited, the legal entity behind the NEXÉ brand.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account or using the NEXÉ App, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding agreement
  • You have read, understood, and agreed to these Terms and our Privacy Policy
  • You are using the App for lawful purposes only

2. Description of Service

NEXÉ is a smart home automation application that allows users to monitor and control connected devices including lighting systems, fans, curtains, dimmers, and other smart devices through NEXÉ Core and NEXÉ Wave hardware systems.

The App provides features including device control, room grouping, scene automation, power consumption monitoring, and cloud backup and restore functionality.

Full functionality requires compatible hardware devices and a stable internet connection.

3. Account Registration

3.1 Account Creation

To use the App, you must create an account by providing accurate and complete information including your name, email address, phone number, and password.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. You must immediately notify us at sindhu@confiolabs.com if you suspect unauthorised access to your account.

3.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions is prohibited.

4. Use of the App

4.1 Permitted Use

You may use the NEXÉ App solely for controlling and managing your own smart home devices in accordance with these Terms and applicable law.

4.2 Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the App
  • Attempt to gain unauthorised access to any systems, networks, or data
  • Interfere with or disrupt the App’s servers, infrastructure, or security
  • Use the App to control devices you do not own or have permission to control
  • Transmit any malicious code, viruses, or harmful data through the App
  • Use the App for any illegal purpose or in violation of applicable law
  • Resell or commercially exploit the App without prior written consent

5. Device Control and Safety

5.1 User Responsibility

You are solely responsible for the configuration, programming, and use of connected devices. NEXÉ is not responsible for physical damage, safety hazards, or property loss resulting from device control actions.

5.2 Scene and Automation Safety

Time-based and device-triggered scenes execute automatically based on your configuration. You are responsible for ensuring automated actions are safe and appropriate for your environment.

5.3 Network Dependency

Cloud-connected features depend on internet connectivity and server availability. NEXÉ does not guarantee uninterrupted connectivity.

6. Intellectual Property

All content, features, branding, software, trademarks, logos, and intellectual property in the NEXÉ App are owned by or licensed to Confio Technologies Private Limited.

You may not copy, modify, distribute, sell, or lease any part of the App or its content without our express written permission.

7. Cloud Sync and Data

By using Cloud Sync:

  • You grant NEXÉ a limited licence to store and process your configuration data
  • You are responsible for ensuring your configurations are accurate before upload
  • NEXÉ does not guarantee data retention indefinitely

8. Third-Party Services

The App integrates with Firebase services provided by Google LLC. Your use of these services is also subject to Google’s Terms of Service and Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

NEXÉ does not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Defects will be corrected promptly
  • The App is free from viruses or harmful components
  • Results obtained from the App will be accurate or reliable

10. Limitation of Liability

To the maximum extent permitted by applicable law, Confio Technologies Private Limited and its directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages.

  • Loss of data, revenue, profits, or goodwill
  • Physical damage to property resulting from device control
  • Service interruptions or loss of connectivity
  • Unauthorised access to your account or devices

Our total aggregate liability shall not exceed the amount you paid, if any, to NEXÉ in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Confio Technologies Private Limited, its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of applicable law or third-party rights
  • Configuration errors or improper use of device control features

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any feature at any time. We may also update these Terms from time to time.

13. Termination

We reserve the right to suspend or terminate your account and access to the App if we reasonably believe you have violated these Terms or applicable law.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

15. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NEXÉ regarding the App.
